2. Unlawful Use

Our services may only be used for lawful purposes. The transmission, storage, or distribution of illegal content is strictly prohibited, including but not limited to:

• Child pornography, obscenity, discrimination, hate speech, threats of violence
• Defamation, stalking, harassment
• Intellectual property violations, including copyright, trademarks, and trade secrets
• Privacy violations, including unauthorised data collection
• Fraudulent activities, including pyramid schemes and impersonation
• Exchange control law violations
• Distribution of pirated software
• Ignoring unsubscribe requests for bulk email

Users outside South Africa must also comply with local laws. Schweet Web Ethekwini will comply with legal orders and assist law enforcement.

3. Prohibited Activities

Any activity threatening network security is forbidden, including:

• Unauthorized access, hacking, spoofing
• Denial-of-Service (DoS), scanning, flooding
• Distribution of malware, including viruses, worms, and Trojans
• Unauthorized traffic or data monitoring
• Mass unsolicited emails, spamming, or chain letters

4. Third-Party Content

Schweet Web Ethekwini acts as a conduit for third-party content such as emails, chat rooms, and websites. We have no control or liability for such content. Users access these spaces voluntarily and at their own risk.

5. Usenet/Newsgroups

Users must adhere to newsgroup policies and must not spam, post off-topic content, post binaries in non-binary groups, or post commercial content without permission.

6. Unsolicited Spam/Junk Mail

The following practices are strictly prohibited:

• Sending unsolicited bulk mail without consent
• Maintaining mailing lists without recipient permission
• Failing to remove unsubscribers or invalid addresses
• Using our service to support illicit emailing practices
• Falsifying headers or identifying Schweet Web Ethekwini improperly
• Allowing mail relay abuse on servers

7. Protection of Minors

Hosting or distributing illegal content involving minors, including child pornography, is strictly prohibited.

8. Privacy & Confidentiality

We respect user privacy. Our Privacy Policy details the collection and use of personal data.

9. User Responsibilities

Users are responsible for their accounts and for preventing unauthorized use. Parents or guardians who enable minor use are responsible for conduct and consequences. Business dealings with third parties accessed through our network are the user's responsibility.

10. Notice and Takedown

We provide a takedown mechanism for reporting content or activity in breach of this AUP. Reports should be submitted in writing and must include all relevant evidence to support the claim.

11. Complaints

Report violations in writing with detailed evidence, such as headers, logs, and contact information. Anonymous complaints are accepted if detailed.

12. Action Following Breach

Upon breach report, Schweet Web Ethekwini may notify network administrators, suspend access, issue warnings, charge administrative costs, assist investigations, instigate legal proceedings, and share breach details with other ISPs or law enforcement.

13. Reservation of Rights

Schweet Web Ethekwini reserves the right to amend this AUP without notice, enforce it as needed, take action against unlisted abuses, monitor traffic for security, suspend or cancel service for threats to the network, remove offensive content at its own discretion, provide best-effort security without guaranteeing data safety, and maintain enforcement rights even if not immediately acted upon.
